KLim gives lectures for lawyers on digital evidence and online dispute resolution
Atty. Kenneth Lim was invited as one of the speakers in the Mandatory Continuing Legal Education (MCLE) sponsored by the IBP Zamboanga del Norte Chapter last June 20-23,2023 held at Mibang Hotel Conference Room, Dipolog City.
On the third day of the MCLE, Atty. Lim lectured on “The Discovery, Seizure, and Authentication of Digital Evidence” wherein he gave practical tips on how to utilize the various modes of discovery in obtaining electronic evidence from the opposing party. He also discussed the search and seizure of digital evidence and the various cybercrime warrants. In the second half of the lecture, he discussed the what, why, who, when, where, and how to authenticate electronic evidence such as social media posts, emails, photographs, audio recordings, and CCTV recordings.
On the last day of the lecture series, Atty. Lim lectured on “Online Mediation and Arbitration in Cross-Border E-Commerce Disputes” wherein he presented the challenges brought about by disputes involving cross-border e-commerce transactions between businesses and consumers and how online dispute resolution could be a viable alternative solution to litigation. He also introduced arbitration to the attendees, discussing an overview of arbitration, the advantages of arbitration, the various arbitration institutions, the arbitration agreement, party autonomy and its limitations, the doctrine of competence-competence, grounds to vacate arbitral awards, and the role of courts in arbitration proceedings.
The MCLE event was well-attended by lawyers from Zamboanga del Norte, Zamboanga del Sur, Zamboanga Sibugay, ZamBaSulta, Lanao del Sur, Misamis Occidental, and even from the Visayas region.
The MCLE is required of Philippine lawyers to ensure that throughout their career, they keep abreast with law and jurisprudence, maintain the ethics of the profession, and enhance the standards of the practice of law (B.M. 850, October 2001).
